Licence agreement
SMK Carousel
Version 1.0 (applies to SMK Carousel 1.0.0 and its updates)
Please read this agreement. By installing or using SMK Carousel (the "Software") you agree to it. If you do not agree, do not install or use the Software.
"We", "us" and "our" mean Vixuals11. "You" means the person (or the single company) that bought or is using the Software.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Software on up to 3 computers that you own or control, for your own work. One licence key is for one user. A studio or team needs one licence per person who uses the Software.
2. What You Create Is Yours
The carousels, compositions, videos and images you make with the Software belong to you. You may use them for any purpose, including commercial work for clients. We claim no rights in them.
3. What You May Not Do
You may not: (a) copy, sell, rent, lend, share, publish or otherwise distribute the Software or your licence key; (b) remove, disable or work around the licence check; (c) decompile, disassemble or reverse engineer the Software, except where the law gives you that right despite this clause or where a third-party licence listed in section 9 gives it to you; (d) use the Software to build a product that competes with it by copying its code or presets; (e) use the Software in breach of the law.
4. No Trial
There is no free trial. Building and updating carousels needs a valid licence key. Previewing stays available without one.
5. Licence Key And Activation
Your key is checked online when you activate it and from time to time afterwards. The check sends your licence key and the product identifier to the store that sold you the Software (Gumroad) and receives back whether the key is valid. We do not send, and cannot see, your projects, media or comp contents. See the Privacy Policy. If a purchase is refunded, charged back or the key is shared beyond the limit in section 1, we may disable the key.
6. Updates And Support
Your licence includes free updates. We may release a later major version as a separate product. Support is by email at vixuals11@gmail.com and is provided on a reasonable-efforts basis.
7. Refunds
All sales are final, as described in the Refund Policy. Rights that the law of your country gives you and that cannot be excluded are not affected.
8. No Affiliation
DaVinci Resolve and Fusion are trademarks of Blackmagic Design Pty Ltd. The Software is made independently and is not affiliated with, endorsed by or supported by Blackmagic Design. You need your own copy of DaVinci Resolve Studio to use the Software.
9. Third-Party Software
The Software includes third-party components, including Qt for Python (PySide6) and Qt WebEngine under the GNU Lesser General Public Licence version 3, and the Python runtime under the Python Software Foundation licence. They are listed, with their licence texts and how to get their source code, in THIRD_PARTY_NOTICES.txt. Those components stay under their own licences. Nothing in this agreement limits your rights under those licences, including your right to replace the Qt libraries shipped with the Software and to reverse engineer the Software as far as needed to debug such a replacement.
10. No Warranty
The Software is provided "as is", without warranty of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not promise that it will be error-free, that it will work with every version of DaVinci Resolve, or that it will not change or damage your compositions. Keep backups of your projects. The Software edits your Fusion compositions; Edit > Undo reverses each change it makes.
11. Limit Of Liability
To the extent the law allows, we are not liable for lost profits, lost data, lost work, or indirect or consequential loss. Our total liability for any claim is limited to the price you paid for the Software. Nothing here limits liability that cannot be limited by law.
12. Ending This Agreement
You may stop at any time by uninstalling the Software. We may end this agreement and disable your key if you break it. Sections 2, 3, 8, 9, 10, 11 and 13 survive.
13. General
This is the whole agreement about the Software. If a part is unenforceable, the rest stays in force. The law of Pakistan governs it, and its courts have jurisdiction, except where mandatory consumer law of your country says otherwise.
